These Terms of Service (“Terms”) are a legally binding agreement between you (“you,” “your,” or “Customer”) and Sharnae Lynn LLC doing business as OurTrendst (“Company,” “we,” “our,” or “us”), a Texas limited liability company. These Terms govern your access to and use of our website, services, and any other offerings that link to these Terms (collectively, the “Services”).

1. Agreement to Our Legal Terms

These Terms, together with our Privacy Notice and any other policies posted on the Services, form the entire agreement between you and the Company regarding your use of the Services. We may update these Terms from time to time; changes are effective when posted with a revised “Last updated” date. It is your responsibility to review the Terms periodically.

Minors (generally under 18) must have permission and direct supervision of a parent or guardian to use the Services.

2. Intellectual Property Rights

Our intellectual property. All content available through the Services — including text, images, designs, source code, graphics, logos and trademarks — is owned or licensed by Sharnae Lynn LLC and protected by U.S. and international copyright, trademark and other intellectual property laws.

Submissions & Contributions. If you submit content or contributions (e.g., reviews, images, comments), you grant us a worldwide, royalty-free, transferable, sublicenseable, perpetual license to use, reproduce, modify, publish, and display that content in connection with the Services. You represent and warrant you own or have the right to submit such content and that it does not violate any third-party rights.

3. User Representations

By using the Services you represent and warrant that:

• All information you provide is accurate, current, and complete.

• You have the legal right and capacity to enter into these Terms.

• You will comply with all applicable laws and these Terms.

• You will not use automated means to access the Services (bots, scrapers) unless expressly permitted.

We may suspend or terminate accounts that provide false or misleading information.

4. User Registration

You may need to register to access certain features. Keep your account credentials secure — you are responsible for all activity on your account. We may reclaim usernames deemed offensive or inappropriate.

Guidelines for reviews

Reviews must be based on first-hand experience and must not contain obscene, defamatory, or discriminatory language. We may reject or remove reviews at our discretion.

The Services may link to third-party sites. We do not control or endorse those sites and are not responsible for their content, privacy practices, or transactions. Your use of third-party sites is at your own risk.

11. Advertisers

We may display third-party advertisements. We are not responsible for advertiser content or offers; any transaction with an advertiser is solely between you and that advertiser.

12. Services Management

We may monitor the Services, remove content, or restrict access to protect the Services and our users. We reserve the right to refuse service, remove content, or suspend accounts for violations of these Terms.

14. Term & Termination

These Terms remain effective while you use the Services. We may suspend or terminate your access at any time for any reason (including breaches of these Terms) without prior notice. Termination does not affect rights and obligations that accrued prior to termination.

15. Modifications & Interruptions

We may change, suspend, or discontinue the Services (or any part) at any time. We will not be liable for any modification, suspension, or discontinuance of the Services.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes not subject to arbitration (see below) shall be brought in state or federal courts located in Texas, and you consent to personal jurisdiction in Texas.

17. Dispute Resolution

Informal negotiation. Before initiating formal proceedings, you and we agree to try to resolve disputes informally by notifying the other party in writing and attempting to resolve for at least 30 days.

Binding arbitration. If informal negotiation fails, most disputes will be resolved by binding arbitration under the American Arbitration Association (AAA) Commercial Arbitration Rules. Arbitration may be conducted in person, by phone, or online. The arbitrator will apply applicable law. You and we each waive the right to jury trial and to participate in a class action. Arbitration is limited to individual claims.

Exceptions. Claims seeking injunctive relief or to protect intellectual property rights, or certain statutory claims, are not subject to arbitration and may be heard in courts in Texas.

Time limit. You must bring any claim within one (1) year after the cause of action arises, unless a longer period is required by law.

18. Corrections

We may correct errors in product descriptions, pricing, or other content. We reserve the right to cancel orders for any reason, including pricing or product availability errors.

19. Disclaimer

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access or error-free operation.

20. Limitations of Liability

To the maximum extent permitted by law, Sharnae Lynn LLC and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of the Services. Our total aggregate liability to you for any claim will not exceed the amount you paid to us in the six (6) months preceding the claim (or $100 if you have not purchased).

21. Indemnification

You agree to indemnify, defend, and hold us harmless from any claim, demand, loss, or damage (including reasonable attorneys’ fees) arising out of: your use of the Services; your Contributions; your violation of these Terms; or your violation of any third-party rights.

22. User Data

We maintain backups of data you transmit to the Services, but you are responsible for any content you submit. We are not liable for any loss or corruption of such data.

23. Electronic Communications

By using the Services and providing contact details, you consent to receive electronic communications from us. Electronic communications satisfy any legal requirement for written notice.

24. California Users

If you have an unresolved complaint, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs (contact info published by that agency).

25. Miscellaneous

These Terms, plus any other policies posted on the Services, are the entire agreement between you and us. If any provision is unlawful, unenforceable, or invalid that provision will be limited or removed but will not affect the rest of these Terms. No agency or employment relationship is created by these Terms.
